JUSTICE SANJAY PRIYA ORAL ORDER 17-05-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Narpatganj (Bathnaha) P.S. Case No. 388 of 2016 instituted for the offence under Sections302, 201/34 of the Indian Penal Code. There is allegation in the written report that the petitioner with help of other associates committed murder of son of the informant.
It has been submitted on behalf of the petitioner that it is admitted that the son of the informant was working as a dancer in the band party of the petitioner. Mere suspicion has been raised in the written report.
The C.D. has been received.
The learned APP has submitted that from the CDR it
Patna High Court Cr.Misc. No.14611 of 2017 (3) dt.17-05-2017 will be apparent that the deceased had talked on mobile phone of one Pushpa Devi. The learned Sessions Judge has mentioned in the impugned order that in paragraph-73 of the C.D. the confessional statement of Pushpa Devi was recorded in which, she stated the complicity of the petitioner along with Rohit Kumar. In this manner, besides the disclosure of the name of petitioner in the confessional statement, mere suspicion has been raised against the petitioner.
In such circumstances, prayer for bail is allowed and it is ordered that the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Narpatganj (Bathnaha) P.S. Case No. 388 of 2016 to the satisfaction of learned Chief Judicial Magistrate, Araria subject to condition that both the bailors should be relatives of the petitioner. (Sanjay Priya, J) A.K.V./- U T
