JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-01-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The occurrence appears to have taken place on account of drainage of water and allegedly, it is said that petitioner gave farsa blow causing injury to injured Sahdeo Mandal, who appears to have sustained two injuries out of them opinion regarding one injury was kept reserved.

The submission on behalf of the petitioner is that there is case and counter case between the parties and the petitioner, too, sustained injury which is evident from perusal of Annexure-2 to this petition. Moreover, petitioner is in jail custody since 16.10.2015.

Considering the aforesaid facts and circumstances as

Patna High Court Cr.Misc. No.2635 of 2016 (2) dt.29-01-2016 2/2 well as submissions of the parties, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in connection with Sikty (Bardaha) P.S. Case No.77 of 2015.
