2. The petitioner has preferred this application for grant of regular bail in connection with Session Case No. 51 of 2023 arising out of Dehri (Muffasil) P.S. Case No. 26 of 2021 dated 03.04.2021 registered for the offences punishable u/s 392 of the Indian Penal Code.

3. As per the prosecution case, four unknown miscreants ridden on two motorcycles are alleged to have come and snatched the bag of the informant containing Rs. 7,38,486/- and they also assaulted him.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in

Patna High Court CR. MISC. No.11103 of 2025(2) dt.16-04-2025 2/3 this case. The petitioner is not named in the FIR. The name of the petitioner has sprung up on mere suspicion. Nothing has been recovered from the conscious possession of the petitioner. It is further submitted that the petitioner has already been granted bail by the learned court below dated 27.04.2022 in B.P. No. 399 of 2022 but the petitioner has not appeared on the date fixed and remained absent for two dates and onwards due to which the bail bond was cancelled. It is further submitted that it is the first misuse of privilege of bail granted to the petitioner. The petitioner has four criminal antecedents as stated in para 3 of the bail petition. The petitioner is in custody since 12.12.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Rohtas at Sasaram in connection with Session Case No. 51 of 2023 arising out of Dehri (Muffasil) P.S. Case No. 26 of 2021, with a condition/s:-

The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
