2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 384, 385, 379, 447, 427, 506 and 34 of the Indian Penal Code.
3. As per prosecution case, informant, namely Madhurendra Nath Verma, alleged that all the F.I.R. named accused persons, including this petitioner, have been illegally excavating soil from his 20 bigha agricultural land situated in Malkaunia and Jamla for the last 20 years. It is further alleged that despite prior arrests and written bond acknowledging no right over the land, the accused persons have continued soil mining using 15-20 tractors daily, damaging land and nearby

4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is quite innocent and has committed no offence. There are general and omnibus allegations and there is no specific accusation of overt act against this petitioner. As a matter of fact, petitioner is a very poor person and does not own any tractor. It is further submitted that there is dispute between co-accused persons and informant with regard to right over the land in question and due to the same, this petitioner and others have falsely been implicated in this case. It is further submitted that similarly situated coaccused persons have been granted the privilege of anticipatory bail by this Hon'ble Court vide order dated 05.09.2022 passed in Cr. Misc. No. 20715 of 2022.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner.
6. Considering the general and ominous nature of accusation and claim based on parity, the prayer for grant of anticipatory bail to the petitioner is allowed.
7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named

No.9604 of 2025(3) dt.18-04-2025 3/3 petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Muffasil P.S. Case No. 343 of 2021, subject to condition as laid down under Section 482(2) of the B.N.S.S..
