The petitioner is apprehending arrest in a case registered for the offences punishable under Section 7 of the Essential Commodities Act.

It is alleged that a raid was led in different sweet shops and the petitioner was proprietor of one of the sweet shops namely Manglam Sweet shop when it was found that domestic gas cylinders were used for the commercial purposes. It is submitted by learned counsel for the petitioner that petitioner never used domestic gas cylinder for commercial purpose. In fact, domestic gas cylinders were kept in the shop for which the petitioner has licence, hence, on suspicion the

Patna High Court Cr.Misc. No.4539 of 2016 (2) dt.03-02-2016 2/2 accusation has been levelled. A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.

The aforesaid facts constitute ground for consideration of prayer for regular bail.

Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Bagaha P.S. Case No.177/2015, pending before the learned ACJM, Bagaha, West Champaran.

With the above observation, this application is, accordingly, disposed off.
