JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 11-05-2023 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Bidupur P.S. Case No. 320 of 2022 registered for the offences punishable under Sections 341, 323, 324, 307, 34, 506, 504 of the Indian Penal Code.
As per the FIR, allegation against the petitioner is that he along with other co-accused assaulted the informant by means of Kudal.
Learned counsel for the petitioner submitted that petitioner has falsely been implicated in this case. He submitted that no specific overt act has been attributed against the petitioner. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the above named petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 25,000/- (twenty five thousand) each with two sureties of the like amount to the satisfaction of the learned Chief Judicial Magistrate, Vaishali in Bidupur P.S.
