====================================================== CORAM: HONOURABLE MR. JUSTICE ARVIND SRIVASTAVA ORAL ORDER 18-03-2024 Heard learned counsel for the petitioner and learned counsel for the State.
2. Petitioner apprehends arrest in connection with Nagar (Sarai O.P.) P.S. Case No. 419 of 2023 registered for the offences under Sections 406, 420 and 34 of the Indian Penal Code.
3. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the instant case. Further submission is that the present case is a counterblast of an earlier case no. 1949 of 2022 which was filed by the petitioner against the informant's husband as contained at Annexure-P/3. It is also submitted that there is also business relation between both the parties due to which the dispute arose
Patna High Court CR. MISC. No.13308 of 2024(2) dt.18-03-2024 2/2 as contained in the agreement at Annexure-P/2 of the petition.
4. Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, the petitioner, above named is directed to be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of J.M.-1'st Class, Siwan in connection with Nagar (Sarai O.P.) P.S. Case No. 419 of 2023, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
