Present:- Member(Judicial) :Mr. Justice Ahsanuddin Amanullah Member(Legal Profession) : Mrs. Tanuja Mishra, Advocate AWARD The dispute between the parties having been referred for determination to the Lok Adalat and the parties having compromised/ settled the case/matter, the following award is passed in terms of the settlement: Heard learned counsel for the petitioner and learned counsel for the State.
The grievance of petitioner relates to initiation of proceeding under Rule 43B of the Bihar Pension Rules, 1950 and subsequent stoppage of her pension and issuance of show cause. From the pleadings on record and assistance by the learned counsel for the parties, it appears that by order dated 12.08.2017, the proceedings have been concluded, though with the observation that in future the same may be initiated in accordance with law. Moreover, by letter dated 01.08.2017, the stopped pension of the petitioner has already been directed to be revived as per the communication from the Senior Treasury Officer, Patna City to the Branch Manager, State Bank of India, Kadamkuan Branch.
Learned counsel for the State assures that if for any period pension has not been paid, upon representation made by the petitioner to the competent authority, the same shall also be done within one month from
the date of filing of such application.
In view of the aforesaid, the grievance of the petitioner having been redressed by the authorities, the application stands disposed off. The parties are informed that the court fee, if any, paid by any of them shall be refunded.
