The Petitioner seeks bail in S. Tr. No. 66 of 2017 arising out of Asaganj P.S. Case No. 47 of 2016 instituted for the offence under Sections 302, 379 and 34 of the Indian Penal Code and Section 27 of the Arms Act.
As per the allegation of the informant, this petitioner along with three other accused persons surrounded her husband and made indiscriminate firing on account of which he died at the spot.
Learned counsel for the petitioner submits that in the post mortem report only two injuries have been found on the person of the deceased, one on the chest and another at the cheek
Patna High Court Cr.Misc. No.19077 of 2017 (3) dt.18-05-2017 2/2 and those injuries get corroboration from the confession made by one of the accused, Sanoj Yadav as stated in para-54 of the case diary, wherein it has been stated that he fired two shots one on chest and another on the cheek. The post mortem report is available with the Case Diary wherein the Doctor has found entry and exit injuries on the chest and one injury on cheek of the deceased. The other witnesses in their statements in the case diary have made similar statements as made by the informant against all the accused persons.
Considering the fact that in the written report the informant has alleged that four accused persons have fired but as per the post mortem report only two injuries have been found, the prayer for bail is allowed. Let the Petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the A.D.J.2nd Munger in connection with S. Tr. No. 66 of 2017 arising out of Asarganj P.S. Case No. 47 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioner.
