Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioner seeks regular bail in connection with Bypass P.S. Case No. 32 of 2022 instituted for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that the petitioner is in custody since 23.01.2022 with the clean antecedent and charge-sheet has been submitted and allegation is of recovery of 2000 litres of liquor from an orchard and petitioner found in a drunken condition.

Learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case as the liquor found from an orchard and it is an open place. He further submits that petitioner is alleged to be found in drunken condition pulling two bags of 200 litres of wine. Learned A.P.P. for the State vehemently opposes the

Patna High Court CR. MISC. No.12463 of 2022(2) dt.21-03-2022 2/2 prayer for regular bail of the petitioner.

Considering the fact that the petitioner is in custody with a clean antecedent and charge-sheet has been submitted, let the petitioner above named be released on bail on furnishing bail bond of Rs.2,000/- (Rupees Two Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna City, Patna in connection with Bypass P.S. Case No. 32 of 2022.
