The petitioner seeks bail in a case registered for the offences punishable under sections 304(B), 201/34 of the Indian Penal Code.

Mani Devi, sister of the informant was married to the petitioner five years ago and allegedly due to non fulfillment of demand of motor cycle by the petitioner, she was being tortured and assaulted and about one month ago from the date of occurrence, the sister of the informant went to her Naihar but the petitioner again brought her back and ultimately killed her with the help of his father and burnt the dead body hurriedly.

Patna High Court Cr.Misc. No.2495 of 2016 (3) dt.11-03-2016 Submission is of false implication and that against the petitioner there is no specific allegation. Father of the petitioner has already been allowed bail vide Criminal Misc. No. 33619 of 2015 and the petitioner being husband is suffering in custody since 15.03.2015.

The learned A.P.P. seriously opposed the prayer by submitting that the informant and other witnesses have supported the allegation and further the petitioner has confessed his guilt also.

In the facts and circumstances of the case stated above and considering the allegation attributed against the petitioner which is serious in nature, I am not inclined to enlarge the petitioner on bail in connection with Rajepur P.S. Case No. 28 of 2015 pending in the court of the learned Sub-divisional Judicial Magistrate, Sikarahana, at Motihari.
