The petitioner is in custody in connection with Naubatpur P.S. Case No. 209 of 2018 for the offence under Sections 323, 307 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel appearing on behalf of the petitioner submits that the allegation of firing against the petitioner is unintentional as he was member of the Barat procession which led injury to the informant. He further submits that petitioner is in custody since 20.07.2018.

Learned counsel for the informant submits that the action of the petitioner is intentional and not unintentional.

No.11557 of 2019(2) dt.26-02-2019 2/2 Considering the fact that petitioner has no criminal antecedent and he has remained in custody for more than seven months, let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Court of learned Sushri Nutan Kumari Judicial Magistrate-1st Class, Danapur, in connection with Naubatpur P.S. Case No. 209 of 2018.
