JUSTICE BIRENDRA KUMAR ORAL ORDER 24-04-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

Petitioner is languishing in custody for the offences punishable under Section 392 of the Indian Penal Code. Petitioner is in custody since 4.11.2016. However, he was not put on T.I. Parade. Two persons snatched the vehicle of the informant and by name they were identified as Manoj Kumar and Chhotu. The alias name of the petitioner is Chhotu. He was not known to the informant.

Learned counsel for the State opposed the prayer of bail on the ground that the petitioner confessed and on the basis of the confessional statement recovery of the vehicle was made from the field side.

Patna High Court Cr.Misc. No.12644 of 2017 (4) dt.24-04-2017 Considering the fact that there is no substantial evidence against the petitioner, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-1st, Samastipur/Successor Court, in connection with Tajpur (Halai) P.S. Case No.334 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court below shall be at liberty to take steps for cancellation of the bail bonds of the petitioner in this case.
