JUSTICE DINESH KUMAR SINGH ORAL ORDER 01-02-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 447, 341, 342, 323, 379, 307, 506, 504 and 34 of the Indian Penal Code. The prosecution case is that in the background of quarrel being going on between Dilkhush Yadav and the son of the petitioner. The petitioner assaulted Dilkhush Yadav with Pharsa and snatched gold chain worth Rs. 30,000/-.

It is submitted by the learned counsel for the petitioner that accusation has been levelled against the petitioner in the background of quarrel between both sides. The marginal size injury has been found though caused by sharp cut weapon. Statement has been made in paragraph-3 of the petition that the

Patna High Court Cr.Misc. No.4316 of 2016 (2) dt.01-02-2016 2/2 petitioner has got no criminal antecedent.

The aforesaid facts constitute ground for consideration of prayer for regular bail let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Singhia P.S. Case No. 155 of 2015 pending in the court of the learned Additional Chief Judicial Magistrate IV, Rosera, Samastipur.
