JUSTICE DINESH KUMAR SINGH ORAL ORDER 25-01-2016 Heard learned counsels for the petitioner and the State. The petitioner being mother of the husband of the victim is apprehending arrest in a case registered for the offences punishable under Sections304B/34 of the Indian Penal Code. The accusation is of killing the daughter of the informant within two years of marriage for non fulfillment of dowry demands. The FIR suggests that the victim was administered poison.

It is submitted by the learned counsel for the petitioner that the victim was provided medical assistance. The postmortem report does not reflect any external injury on the dead body of the victim and the viscera has been preserved. It is further submitted that the thrust of accusation is against the husband of the victim who is in custody.

No.3735 of 2016 (2) dt.25-01-2016 2/2 Considering the suspicious nature of accusation in the FIR coupled with the fact that petitioner is lady, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM, Bhojpur at Ara in connection with Narayanpur P.S. Case No.45 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
