JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 17-05-2017 Seen the report submitted by the learned lower court. This case is based upon circumstantial evidence. At an earlier occasion while considering the prayer for bail of the petitioner under Cr. Misc. No.54317/2016 same was rejected vide order dated 23.12.2016 (Annexure-1) giving liberty to renew after framing of charge. From the report submitted by the learned lower court, it is evident that on 07.03.2017 charge had already been framed. Subsequently thereof, the record has been called for by the District & Sessions Judge, West Champaran at Bettiah in Cr. Misc. No. 45 of 2017. Furthermore, one of the co-accused Khalikuzzama had also been released on regular bail vide Cr. Misc. No.44634/2016.

No.17829 of 2017 (3) dt.17-05-2017 In the aforesaid background, petitioner Khushnama is directed to be released on bail on furnishing bail bonds of Rs.10,000/-(ten thousand) with two sureties of the like amount each, to the satisfaction of learned Additional District & Sessions Judge, 1st, Bettiah, West Champaran in connection with Sessions Trial No.103 of 2017 arising out of Sikta P.S.
