JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 02-06-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of regular bail arises out of Sarai P.S. Case No.69 of 2018 registered for the offence punishable under Section 394 of the Indian Penal Code and Section 27 of the Arms Act.

It is alleged in the First Information Report that four persons, armed with the guns, entered into the office of the Bank and after assaulting the informant and employees of the Bank with butt of the gun looted cash to the tune of Rs.2,65,865/-, DVR of CCTV and five cell phones of staff of the Bank along with other articles.

Learned counsel for the petitioner has submitted that his name has surfaced on the basis of confessional

Patna High Court CR. MISC. No.16145 of 2020(2) dt.02-06-2020 2/2 statement of one Prince Kumar @ Abhijeet Kumar. He has referred to an order of this Court dated 30.07.2019 passed in Cr. Misc. No. 46767 of 2019, whereby said Prince Kumar @ Abhijeet Kumar has been allowed regular bail by this Court. He has further submitted that other co-accused persons, whose names have surfaced on the basis of the confessional statement of Prince Kumar @ Abhijeet Kumar, have been allowed regular bail by this Court.

Considering the above submission, this application is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Vaishali at Hajipur, in Sarai P.S. Case No. 69 of 2018.
