This application for regular bail arises out of Manpur P.S. Case No. 64 of 2018, disclosing offences punishable under Sections 147,148,149,341,323,302 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel appearing on behalf of the petitioner has submitted that there is no allegation against the petitioner of having made any assault. He is said to have instigated others to kill the deceased. From the First Information Report, it appears that some dispute, trivial in nature, is the genesis of the occurrence.

Learned counsel appearing on behalf of the petitioner has argued that the postmortem report does not indicate any

Be that as it may, since there is no specific allegation of assault against this petitioner, who is in custody since 21.09.2019, this application is allowed.

Let the petitioner above-named be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Nalanda in connection with Manpur P.S. Case No. 64 of 2018.
