JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 25-10-2021 Heard learned counsel for the petitioner, learned Additional Public Prosecutor for the State as well as learned counsel appearing on behalf of the informant. Petitioner seeks bail in Masaurhi P.S. Case No.557 of 2020, registered for the offences punishable under Sections 147, 148, 149, 323, 307, 302, 354, 379, 448 and 452 of the Indian Penal Code as well as under Section 27 of the Arms Act. Allegation against the petitioner is that the petitioner along with other FIR named accused persons entered into the house of the informant with lathi, danda, iron rod, pistol and farsa. One Mantu Kumar started firing and Ranjeet Kumar took out Rs.10,000/- from box and Pintu Kumar snatched golden chain from Mintu Devi. Thereafter the accused persons fled

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. There is general and omnibus allegation against the petitioner and other co-accused persons. There is land dispute between the parties. It is further submitted that the petitioner is in custody since 11.09.2020 and the petitioner has got no criminal antecedent as stated in paragraph 3 of the bail petition.

Having considered the facts aforesaid, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Masaurhi in connection with Masaurhi P.S. Case No.557 of 2020.
