JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 26-04-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Fatehpur P.S. Case No. 27 of 2016, registered under Section 302 of the Indian Penal Code.

The accusation is of killing of the sister of the informant by her husband by pressing her neck. Learned counsel for the petitioner submits that admittedly the petitioner is the husband of the deceased and before 10 years, the marriage of the deceased was performed with the petitioner. Further submission is that three children were born out of the wedlock of the deceased and petitioner. Further submission is that, in fact, due to financial crises the

No.14215 of 2017 (3) dt.26-04-2017 2/2 deceased, wife of the petitioner, committed suicide by hanging herself, but with ulterior motive the petitioner has falsely been implicated in this case. Further submission is that there is no family members of the petitioner to look after his children. The petitioner having no criminal antecedent is in custody since 20.02.2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge-II, Gaya in connection with Fatehpur P.S. Case No. 27 of 2016.
