JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 07-04-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners are accused in connection with Murar P.S. Case No. 08 of 2016, registered under Sections 364 and 120(B)/34 of the Indian Penal Code.

The prosecution case in brief is that in the evening of 25.02.2016 Vijay Shankar, son of the informant, had gone to Chaugai Market, but he did not return to his house and in course of search, it was found that on 25.02.2016 on Fula Devi came at the house of the informant and made query about Vijay Shankar saying that she know Vijay Shankar in course of his visit at his Fufa's house and she is also resident of his Fua house. In the meantime, Vijay Shankar also came in the house and Fula Devi went to bus stand. In the same night, Shiv Mangal Ram and

No.14170 of 2017 (2) dt.07-04-2017 2/2 Mahendra Ram came to the house of informant and asked about his son Vijay Shankar and the informant told that he will informed his son. Later on, informant came to know that Mahendra Ram, Shiv Mangal Ram, Fula Devi, Satendra Kumar, Kamlesh Kumar under conspiracy kidnapped his son Vijay Shankar with intention to kill him due to illicit relation of Satendra Kumar with Fula Devi.

Learned counsel for the petitioner submits that it would appear from the F.I.R. that petitioners have falsely been implicated in this case along with others mere on suspicion and both have no criminal antecedent are in custody since 08.11.2016 and 14.11.2016, respectively.

Having regard to the facts and the circumstances of the case, the petitioners, above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sessions Judge, Buxar in connection with Murar P.S. Case No. 08 of 2016.
