The petitioner seeks regular bail in connection with Rajapakar P.S. Case No. 128 of 2021 lodged under Sections 393, 413 and 414 of the Indian Penal Code and Section 25 (1-b)a, 26 and 35 of the Arms Act.
Learned counsel for the petitioner submits that petitioner has named in the FIR, no arms have been recovered from his possession. As per the FIR, he was in possession of black colour Splendor Plus motorcycle, 1 master key and 1 knife was recovered from his possession. Nothing incriminating material was recovered from his possession and the petitioner is in custody since 15.05.2021. Charge sheet has already been filed in this case. Patna High Court CR. MISC. No.11261 of 2022(2) dt.29-06-2022 2/2 was granted anticipatory bail by a Coordinate Bench of this Court vide order dated 24.12.2021 passed in Cr. Misc. No. 56622 of 2021 (Annexure-2) and other co-accused Sunny Kumar was granted regular bail vide order dated 21.03.2022 passed in Cr. Misc. No. 50866 of 2021.
Learned APP for the State opposes the prayer for bail. In the present facts and circumstances that the petitioner is in custody since 15.05.2021, charge sheet has already been filed and two similarly situated co-accused persons have been granted anticipatory and regular bail by a Coordinate Bench of this Court, let the petitioner above named, be granted bail on furnishing bail bonds of Rs. 20,000/-(Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Vaishali at Hajipur in connection with Rajapakar P.S.
