This is an application for bail in connection with Buxar (T) P.S.Case No. 507 of 2016 registered for the offences punishable under Sections 290, 272, 273, 414, 120B/34 of the Indian Penal Code and 37(a) of Excise Act.
It has been submitted on behalf of the petitioners that petitioner has falsely been implicated in this case and it is alleged that 23 ATM cards 15 bottles, containing 180 ml. each, of foreign liquor have been recovered from the petitioner and petitioner is in custody since 4.11.2016.
Heard learned APP also, who has opposed the prayer for bail.
Having heard both sides and considering the nature of
Patna High Court Cr.Misc. No.8635 of 2017 (3) dt.03-03-2017 2/2 allegation, I am not inclined to grant bail to the petitioner at this stage.
However, petitioner may renew his prayer for bail after framing of charge before the court below itself. Accordingly, this application is dismissed.
