JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-01-2016 Heard learned counsels for the petitioner and the State. The petitioner being brother of the husband of the victim is languishing in custody since 5.8.2015 in a case registered for the offences punishable under Sections 498A,302 and 201/34 of the Indian Penal Code.

The prosecution case is of killing the daughter of the informant after about ten years of marriage.

It is submitted by the learned counsel for the petitioner that the accusation is not specific against the petitioner. More over, during investigation the witnesses did not support the accusation against the petitioner and the informant retracted from the initial version and has filed a petition to that effect before the learned court below. Patna High Court Cr.Misc. No.58191 of 2015 (2) dt.04-01-2016 2/2 has already concluded and co accused Munshi Singh, the father of the husband of the victim has been granted bail vide Cr. Misc. No. 31079 of 2015.

Considering the fact that the investigation has already concluded, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Bhojpur at Ara in connection with Agiaon (Garahani) P.S. Case No. 115 of 2014.
