JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 02-06-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through Video Conferencing. The petitioner is accused in connection with Bhagwanpur P.S. Case No. 175 of 2019, registered under Sections 366(A)/34 of the Indian Penal Code.

The accusation is that in the morning of 30.09.2019, Priti Kumari, daughter of informant, Shaila Devi, aged about 16 years, moved from her house without giving information in the family. Thereafter, informant started to search her daughter then she came to know that Baljit Paswan and his mother, Manju Devi (petitioner) enticed away her daughter for the purpose to perform the marriage.

Learned counsel for the petitioner submits that, in

No.8891 of 2020(3) dt.02-06-2020 2/2 fact, petitioner and the informant are co-villagers and betel shop is being run by her son, co-accused, Baljit Paswan, in front of the house of the informant and in that course, son of the petitioner fallen in love with the daughter of the informant and moved from her house according to her own sweet will but with ulterior motive, petitioner being the mother of Baljit Paswan has falsely been implicated in the present case. It is further submitted that petitioner is in custody since 21.10.2019. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai, in connection with Bhagwanpur P.S. Case No. 175 of 2019. Out of two sureties, one surety must be the close relative of the petitioner.
