The petitioner apprehends his arrest in connection with Ahiyapur P.S. Case No.132 of 2014 for offences punishable under sections 363, 366(A) and 506/34 of the Indian Penal Code.
The allegation against the petitioner is of enticing the daughter of the informant for immoral purposes. Mr.
Chandrashekhar Anand, learned counsel appearing for the petitioner with reference to the statement of the victim girl present at Annexure-2 recorded under section 164 of the Code of Criminal Procedure submits that a perusal of the same would manifest that except that the petitioner has accompanied the daughter of the informant there is no immorality attached to it. He further submits that the statement
Patna High Court Cr.Misc. No.4757 of 2016 (4) dt.16-03-2016 also reflects that no protest was shown by the victim girl during the process.
Having heard learned counsel for the parties and considering the nature of the circumstance, let the petitioner, namely, Kundan Paswan in the event of his arrest or surrender within four weeks from today be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur in connection with Ahiyapyur P.S. Case No.132 of 2014 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure. (Jyoti Saran, J) deepika/- U T
