2. The petitioner seeks bail registered for the offence under Section 25(1-b)a, 26(i) and 35 of the Arms Act.

3. As per the prosecution case, it is a case of recovery of four live cartridges and one mobile from the possession of the accused persons.

Learned counsel for the petitioner has submitted that petitioner has falsely been implicated in this case. He next submits that nothing has been recovered from his possession and petitioner is in custody since 17.08.2023. He next submits that similarly situated co-accused has already been granted bail by a Co-ordinate Bench of this Court passed in Cr. Misc.

Learned APP appearing for the State, opposes the prayer for bail of the petitioner. 6.

Considering the facts and circumstances of the case, let the petitioner, above named, be directed to be released on bail in connection with Gogri P.S. Case No.290 of 2023 on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Khagaria.
