2. The petitioner seeks bail in connection with S.T. No.629 of 2022 arising out of Nautan PS Case No. 103 of 2022 instituted for the offences punishable under Section 302 of the Indian Penal Code.

3. As per the prosecution case, the allegation against the petitioner is to commit murder of the son of the informant along with other co-accused persons.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence and has falsely been implicated in this case merely on the basis of dirty village politics and ill motive. Petitioner is not named in the FIR

Patna High Court CR. MISC. No.15344 of 2024(2) dt.18-03-2024 2/3 and there is no any recovery from the conscious possession of the petitioner. There is no any eye witness of the occurrence and the petitioner has been made accused only on the basis of confessional statement of one Bachcha Singh. Petitioner is in custody since 20.07.2022.

5. Learned APP opposes the prayer for bail.

From perusal of the FIR and impugned order of the learned 1st, Additional District and Sessions Judge, Siwan dated 15.12.2023, it appears that petitioner is not named in the FIR and his name transpired in this case only on the basis of suspicion. From perusal of the FIR, it also appears that the case has been registered under Section 302 of the IPC against unknown person and the name of the petitioner has been surfaced on the basis of confessional statement of co-accused. Similarly situated co-accused persons namely Srikant Singh and Bacha Singh have been granted bail by a co-ordinate Bench of this Court in Cr. Misc. No. 69947 of 2022 vide ordeer dated 19.06.2023, accordingly the prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J.-I, Siwan in connection with Sessions Trial No. 629 of
