The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 353, 337, 338, 307, 420, 120B of the Indian Penal Code, 27 of the Arms Act, sections 33/41/42 of the Indian Forest Act, section 4 (1),(1A) of the Mines and Minerals (Development and Regulation) Act and Rule 40(1) of the Bihar Minor and Minerals Concession Rules.
Prosecution case is that the police raided the place of running illegal crusher unit, when the crusher machine was seized then the villagers attacked the police force. A 'dumpher' was found parked near the crusher unit and the petitioners were identified as
Patna High Court Cr.Misc. No.4359 of 2016 (2) dt.01-02-2016 2/2 a member of the mob.
It is submitted by learned counsel for the petitioners that accusation is against the mob only on suspicion; the petitioners have been roped in the present case. A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.
Considering the accusation is omnibus and general against the petitioner, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned SDJM, Dihri, Rohtas in connection with Dihri Nagar P.S. Case No.251/2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
