JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-03-2019 This application, for grant of anticipatory bail, arises out of Paliganj P.S. Case No. 60 of 2018, disclosing offences under Sections 392, 395 and 412 of the Indian Penal Code. Allegation as per F.I.R is that a truck loaded with goods was taken away by the miscreants and it is alleged that the goods loaded in the said truck has been recovered from the house of the petitioner.
Submission of learned counsel for the petitioner is that the petitioner is not named in the F.I.R. and has been made accused in this case only on the basis of suspicion. A statement has been made in paragraph -3 of the petition that petitioner has no criminal antecedent.

Having heard both sides, in view of the above facts,
Patna High Court CR. MISC. No.15307 of 2019(2) dt.26-03-2019 2/2 this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned SDJM, Danapur, Patna, in connection with Paliganj P.S. Case No. 60 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
