JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12-04-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. There is omnibus allegation of assault against the petitioner and others. Earlier, the prayer for bail of the petitioner was rejected by this Court vide order dated 30.11.2016 passed in Cr. Misc. no. 47168 of 2016, giving liberty to the petitioner to renew his prayer for bail after framing of the charge. Admittedly, the charge has already been framed and the petitioner does not have any criminal antecedent and the contents of the F.I.R disclose that the alleged occurrence took place on account of trivial dispute.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on

Patna High Court Cr.Misc. No.13147 of 2017 (2) dt.12-04-2017 2/2 bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of SubDivisional Judicial Magistrate, Sheikhpura in connection with Ariyari P.S. Case No. 11 of 2016.
