JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 15-09-2020 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in GR Case No. 3554/2019, Belaganj Police Station Case No. 239/2019 registered for the offences punishable under Section 304B and other allied sections of the Indian Penal Code. It is stated that the son of the petitioner had married to the victim through court in 2016. Since then, the petitioner and his family members subjected her to cruelty and finally killed her by administering poison for non-fulfiloment of the dowry in 2019.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Petitioner is father-in-law of the victim and he lives separately from his son and the victim. He submits that there is general and omnibus allegation against the petitioner. Learned counsel for the State oppose the prayer for bail of the petitioner stating that there is allegation of demanding dowry by the petitioner also. Moreover, during investigation witnesses have supported the allegation against the petitioner.
