Learned counsel for the petitioner undertakes to remove the defects within three weeks. In the eventuality of non-removal of defects within undertaken period, the office will place the matter before the Bench.
The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 447, 341, 323, 325, 307, 504, 506/34 of the Indian Penal Code. Petitioner along with other accused persons are said to have assaulted the informant on his hand by means of lathi causing fracture injury.
It is submitted by learned counsel for the petitioner that petitioner is innocent and has been falsely implicated in this case. He submits that there is general and
Patna High Court CR. MISC. No.11153 of 2022(2) dt.03-08-2022 2/2 omnibus allegation levelled against the petitioner. He submits that the injury nos. 3, 4 and 5 are found to be simple nature. He further submits that petitioner has one criminal antecedent as stated in para-3 of this application.
Learned APP for the State opposes the prayer for bail and submits that the injury nos. 1 and 2 found upon the victim is grievous in nature.
Considering the nature of allegation, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for anticipatory bail is rejected in connection with Chanan P.S. Case No. 45 of 2021.
