====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 02-09-2024 Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel for the opposite party No. 2.
2. The petitioner apprehends his arrest in connection with C.R. Case No. 812 of 2021 for the offences punishable under Section 498A of the Indian Penal Code.
3. Learned counsel appearing on behalf of the petitioner submits that the dispute between the parties has been settled through process of mediation. The terms of settlement mutually agreed upon by the parties and the same is kept at 'Flag-M'.
4. Learned counsel for the opposite party No. 2 does
Patna High Court CR. MISC. No.12846 of 2024(4) dt.02-09-2024 2/2 not dispute the aforesaid contention.
5. Having considered the fact that the dispute between the parties has already been resolved through mediation, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of six weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Samastipur in connection with C.R. Case No. 812 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. with further condition that petitioner shall abide by all the terms & conditions, mentioned in Memorandum of Agreement dated 22.08.2024 before the Mediation Centre, failing which, learned Court below shall be at liberty to cancel the bail-bond of the petitioner.
