The petitioner seeks bail in a case registered under Sections 228, 353 and 506 of the Indian Penal Code. The allegation against the petitioner is that he disturbed the court proceeding by shouting loudly. The petitioner is in custody since 29.08.2016.

Looking into the nature of allegation against the petitioner it appears that he has sufficiently been punished as he is in jail custody for last eight months, let above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M-12, Motihari, East Champaran at

Patna High Court Cr.Misc. No.11407 of 2017 (5) dt.19-04-2017 2/2 Motihari in connection with Motihari Town P.S.Case No. 551 of 2016, subject to the condition that both bailors will be close relative of the petitioner.

The petitioner is directed to file an affidavit before the court below that he will not indulge in such type of activity in future and he will not try to hamper the trial by intimidating or influencing the witnesses.
