According to the prosecution case itself, neither petitioner was caught on the spot nor anything was recovered from his conscious possession and his name surfaced in this case in the confessional statement of co-accused who was caught on the spot. Some of the co-accused, who were caught on the spot, have already been granted privilege of bail by coordinate bench of this court.

Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Munger in Muffasil (Munger) P.S. Case no. 216/2013.
