Petitioner was arrested in course of investigation on the basis of confessional statement of co-accused and except the aforesaid material as well as some criminal antecedent of the petitioner, there appears to be nothing against him.

Petitioner is in jail custody since 19.11.2015. Learned counsel for the petitioner submits that petitioner was made accused not only in the present case but in some other cases also of similar nature only on the basis of suspicion and no stolen article has been recovered from conscious possession of the petitioner. Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Patna in Kankarbagh P.S. Case no. 296/2015.
