The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 379, 504/34 of the Indian Penal Code. The prosecution case is that on 21.11.2015 at 12.00 A.M. the informant was going to market, on the way, petitioner no. 1, Kare Ram @ Raju Ram met to the informant and demanded money for consuming liquor. On protest being made petitioner no. 1, snatched money from the informant. Thereafter petitioenr no. 1 called his brother petitioner no. 2 Krishna Kumar @ Krishna Kumar Ram, who came there and assaulted the informant by means of rod on his right shoulder, back and leg. Patna High Court Cr.Misc. No.4865 of 2016 (2) dt.05-02-2016 further alleged that petitioner no. 1 snatched gold locket from the neck of the informant.
It is submitted by the learned counsel for the petitioners that for the occurrence of 21.11.2015 the First Information Report was registered on 27.11.2015. The brother of the petitioner Raj Kumar Ram lodged Complaint Case No. 1234C of 2015 on 25.11.2015 against the informant levelling accusation of theft against him, thereafter on 27.11.2015 the present case has been lodge. Statement has been made in para3 of the petition that petitioner has no criminal antecedent Considering the case lodged by the petitioners' side at earlier point of time and delayed lodging of the First Information Report, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Khagaria (Mufassil) P.S. Case No. 751 of 2015, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
