This is an application for bail in connection with Gopalganj Mahila P.S.Case No. 09 of 2016 registered for the offences punishable under Sections 376 (2)(H) of the Indian Penal Code and Sections 3, 4, 7 & 8 of POCSO Act.
It has been submitted on behalf of the petitioner that medical report does not corroborate the prosecution story as no injury was found on the person of the victim and petitioner is in custody for about six months.
Heard learned APP also.
Having heard both sides and in view of nature of allegation made in the FIR, I am not inclined to grant bail to the petitioner. Prayer for bail is rejected.
However, considering the fact that petitioner is in
Patna High Court Cr.Misc. No.9863 of 2017 (2) dt.01-03-2017 2/2 custody, trial court is directed to expedite the trial of the petitioner. Accordingly, this application is dismissed.
