This application for regular bail arises out of S.T. No. 161/2018 arising out of Bangaon P.S. Case No. 48 of 2017, disclosing offences punishable under Sections 302, 120B and 201 of the Indian Penal Code.
It is evident from the First Information Report that the implication of the petitioner is on the basis of suspicion only. The informant is son of the victim. Case diary has been called for, which is there on record. There is no material in the case diary, over and above, what has been alleged in the F.I.R. to connect the petitioner with the alleged offence. It also appears that similar circumstanced co-accused Ranjeet Yadav and Arjun Khan have been allowed regular bail by this Court by orders
Patna High Court CR. MISC. No.9303 of 2020(3) dt.01-06-2020 2/2 dated 26.11.2018 in Cr. Misc. No. 68118 of 2018 and 19.02.2018 passed in Cr. Misc. No. 62798 of 2017. The petitioner is in custody since 08.08.2018.
Considering the fact and circumstances, this application is allowed.
Let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Presiding Officer, F.T.C., Saharsa in connection with S.T.
