JUSTICE SANJAY PRIYA ORAL ORDER 23-03-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Laheri P.S. Case No. 242 of 2013 instituted for the offence under Section 395 of the Indian Penal Code.

As per the written report, three miscreants entered into the house of the informant and took away various articles. It has been submitted that the petitioner is neither named in the First Information Report nor there is any recovery from his possession.

From the order of the learned Sessions Judge it appears that there is no substantive material against the petitioner in the case diary. He is not named in the First Information Report.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Biharsharif, Nalanda, in connection with Laheri P.S. Case No. 242 of 2013, subject to the condition that both the bailors will be the close relatives of the petitioner.
