The Petitioners seek bail in Dandari P.S. Case No. 72 of 2016 instituted for the offence under Section(s) 273/34 of the Indian Penal Code and 47(a), 53(1), 57, 60(1) of the Bihar Excise (Amendment) Act, 2016.
It is alleged that 4 litres of mahua liquor have been recovered from the house of the petitioners. It has been mentioned in the written report that one boy managed to run away, petitioner No. 1 who is a lady was found sitting in the hut and petitioner No. 2 was apprehended by the police on chase.
From the impugned order, it appears that both
Patna High Court Cr.Misc. No.9616 of 2017 (2) dt.11-04-2017 2/2 these petitioners are in custody since 01.01.2017. It has been mentioned in para 3 of the petition that petitioners have no criminal antecedent. In the facts and circumstances of the case, prayer of the petitioners for grant of bail is allowed. Let the Petitioners, above named, be released on bail on furnishing bail bond of 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-III, Begusarai in connection with Dandari P.S. Case No. 72 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioners.
