JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 22-02-2019 Heard learned counsel for the petitioners and learned learned Additional Public Prosecutor for the State. The petitioners are in custody in connection with Dhamdaha P.S. Case No. 95 of 2013 for the offenses under Sections 147, 148, 149, 307, 302, 201, 120B and 504 of the Indian Penal Code.

Learned counsel for the petitioners submits that petitioners have no criminal antecedent. In the instant case 96 persons have been named as assailants along with 40-50 others unknown. In fact, entire villagers have been made accused in this case. The petitioner are in custody since 16.09.2018. The investigation in the instant case is now complete. Similarly

Patna High Court Cr.Misc. No.10785 of 2019(2) dt.22-02-2019 2/2 circumstanced other co-accused have been granted bail by different Benches of this Court.

Considering the fact that the petitioners have no criminal antecedent and they have remained in custody for nearly five months and similarly circumstanced other coaccused have been granted bail, let the petitioners, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Purnea in connection with Dhamdaha P.S. Case No. 95 of 2013.
