JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 26-03-2018 Heard learned counsel for the petitioner and the State. The petitioner is aggrieved by the order dated 14.11.2015, passed by the District Teachers Employment Appellate Authority, as contained in Annexure-16. The writ petition was filed on 1.2.2016 and thereafter the State Appellate Authority has been made functional.

In view of the subsequent development when the State Appellate Authority is available to hear the appeal against the

Patna High Court CWJC No.2156 of 2016(4) dt.26-03-2018 2/2 decision of the District Teachers Employment Appellate Authority, it would be appropriate if the petitioner approaches the State Appellate Authority for redressal of his grievance by way of filing appeal. In the event the petitioner files appeal within a period of one month from today, the State Appellate Authority is required to decide the appeal on its own merit in accordance with law after condoning the delay, if any, in filing the appeal in view of the fact that the present writ petition remained pending for more than two years.

With the aforesaid liberty, the writ petition stands disposed of.
