2. Petitioners apprehend their arrest in connection with Sangrampur P.S. Case No. 283 of 2022 registered for the offences punishable under Sections 341, 342, 323, 324, 325, 307, 379, 504/34 of the Indian Penal Code.
3. As per the prosecution case, the allegation against the petitioners is that they along with other co-accused went to the shop of informant armed with Lathi and Danda and
Patna High Court CR. MISC. No.15515 of 2024(5) dt.13-09-2024 2/3 assaulted them.
4. Learned counsel for the petitioners submit that there is counter case also and petitioner no. 1 has also been injured and he is informant of the counter case. He also submits that the matter has been settled between the parties and a compromise petition has been filed in the court below. He also submits that pursuant to the compromise all the members of the prosecution side, who are accused in the counter case have been granted bail by the court below.
5. Considering the aforesaid facts this application is allowed.
6. Let the petitioners above named, in the event of their arrest/ surrender within four weeks from today to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Motihari, East Champaran in Sangrampur P.S. Case No. 283 of 2022, subject to condition as laid down under Section 438(2) of the Cr.P.C.
