JUSTICE SATYAVRAT VERMA ORAL ORDER 01-08-2022 By order dated 13.05.2022, prayer for anticipatory bail of petitioners no. 1 and 3 has already been allowed. Heard learned counsel for the petitioner no. 2 and 4 and learned A.P.P. for the State.
The petitioner no. 2 and 4 apprehend their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 379 and 504 of the Indian Penal Code read with Section 27 of the Arms Act.
Learned counsel for the petitioner no. 2 and 4 submits that petitioner no. 2 has antecedent of one case and petitioner
Patna High Court CR. MISC. No.21112 of 2021(4) dt.01-08-2022 2/3 no. 4 is a person with clean antecedent.
On account of land dispute, the present occurrence took place wherein it is alleged that Ashok Rai (petitioner no. 2) assaulted by knife causing injury on the eye and face of Vijay Rai and Awadh Kishore Rai (petitioner no. 4) assaulted by sword causing injury on the head and hand of Ganaur Rai. Learned counsel for the petitioner no. 2 and 4 submits that on account of land dispute, the present occurrence took place and there is case and counter case and from perusal of the case diary, it would manifest that the injuries suffered by the injured Vijay Rai and Ganaur Rai are simple in nature. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner no. 2 and 4 but fairly submits that the injuries suffered by the injured are simple in nature.
Considering the submissions made by the learned counsel for petitioner no. 2 and 4, petitioner no. 2 and 4 abovenamed, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.
