2. The petitioner seeks bail in Muffasil P.S. case No. 864 of 2023 instituted for the offences under Sections 341, 323, 324, 307, 379, 498(A), 406, 504, 506 and 34 of the Indian Penal Code.

3. Prosecution allegation, in short, is that the informant has advanced loan to the petitioner and when she asked to return, the petitioner abused and also assaulted her. The petitioner also attacked on the brother of the informant due to which he sustained injury.

4. Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.14014 of 2024(2) dt.07-03-2024 2/2 petitioner has falsely been implicated in the present case. Charge-sheet has been submitted in this case. The brother of the informant sustained lacerated wound on her forearm, as such, the injury report does not corroborate with the allegation made in the F.I.R. The petitioner is in custody since 27.09.2023 and has one criminal antecedent as per statement made in paragraph 3 of the application.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the aforesaid facts and circumstances of the case and the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.

7. Let the petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Muffasil P.S. case No. 864 of 2023.
