JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 02-06-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through Video Conferencing. The petitioner is accused in connection with Sarai P.S. Case No. 232 of 2019, registered under Section 394 of the Indian Penal Code and Section 27 of the Arms Act. The accusation is that on 24.06.2019, at about 9.30 P.M., informant, Mukesh Kumar, proceeded from Patna to Darbhanga boarding in Scorpio vehicle bearing registration no. BR-07PA-5977. In the way, four persons, boarding on two motorcycles, overtaken his Scorpio vehicle and started indiscriminate firing, in which, he sustained one injury at his right armpit and other firearm injury at his left wrist. Thereafter, he stopped the Scorpio vehicle then two miscreants dashed
Patna High Court CR. MISC. No.8792 of 2020(3) dt.02-06-2020 2/3 him out from Scorpio vehicle and out of whom, one took away the Scorpio vehicle towards Muzaffarpur. Thereafter, anyhow informant reached at the Vaishali Petrol Pump, where he become unconscious. The informant also disclosed the physique of the culprits.
Learned counsel for the petitioner submits that, in fact, petitioner and one Sumit Kumar were apprehended by the police with arms on 24.06.2019, regarding which, Hajipur Sadar P.S. Case No. 401 of 2019 was instituted and thereafter, police got recorded the confessional statement of Sumit Kumar showing the recovery of looted Scorpio vehicle in front of hotel and thereafter, petitioner remanded in the present case on 03.07.2019 since then he is in custody. Further submission is that petitioner has not been put on T.I. Parade up till now while the informant has claimed to identify the culprits and on investigation, the charge sheet has already been submitted against the petitioner.
Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur,
