2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 103(1), 61(2) & 3(5) of the BNS and under Section 27 of the Arms Act.
3. The case of the prosecution, in short, is that one Kamlesh Rai has fired at Shivpoojan Rai due to which he died.
4. Learned counsel for the petitioner submits that from perusal of the FIR it is clear that there were four persons on bike including the petitioner. Learned counsel for the petitioner has further submitted that only role attributed to the petitioner is that he has identified Shivpoojan Rai and after that Kamlesh Rai has fired. Learned counsel for the petitioner has further submitted that there is direct allegation of firing against Kamlesh Rai and the deceased has received only one gunshot injury. During course of

No.13843 of 2026(2) dt.12-03-2026 2/2 investigation police has recorded the confessional statement of this petitioner wherein this petitioner has stated that he has fired at the deceased and concealed the firearm in a white bag in the bush near Purushottampur, Tikapur, Siman. Learned counsel for the petitioner has submitted that the petitioner is having no criminal antecedent and he is in judicial custody since 30.05.2025.
5. Learned trial court has relied mostly on the confessional statement of the petitioner whereas there is direct allegation is against Kamlesh Rai of firing. Only role attributed to this petitioner is that he has identified the deceased.
6. Learned APP appearing for the state has opposed the prayer of regular bail.
7. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Bahoranpur P.S. Case No. 68 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Bhojpur at Ara.
