Learned counsel for the appellant is permitted to correct the prayer portion of the instant memo of appeal. Chowkidar Harilal Paswan was returning after service of summon on 22.05.2016. At about 9 am, when he came near Goradhar, he was murdered and for that, the informant; his son had filed the written report, basis of the instant appeal. Furthermore, from the written report, it is evident that on account of provocation given by Khokha Mukhia, petitioner Sanju Devi abetted the offence by instigating her husband and sons who committed the murder of Chowkidar in order to take revenge against murder of her son namely Jitendra Mukhia. The appellant happens to be
Patna High Court CR. APP (SJ) No.529 of 2017 (4) dt.01-05-2017 2/2 under custody since 24.05.2016.
Consequent thereupon, setting aside the order dated 26.10.2016 passed by learned Sessions Judge 1st, Supaul in S.T. no. 202 of 2016 to the extent of appellant Sanju Devi relating to Balua Bazar PS case no. 111 of 2016, appellant Sanju Devi is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned lower court. Accordingly, the instant appeal is allowed.
